The rules of using Gutski.

1. Agreement to terms

By downloading, accessing, or using the Gutski mobile application (the "App") and related services (collectively, the "Service") provided by NO CAP KRE8 LLC ("Gutski," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 18 years old to use Gutski.

2. The service

Gutski is a consumer wellness application that helps users track gut health through:

• AI-powered meal photo analysis
• A daily Gut Score (0–98) that reflects diet, timing, and self-reported wellness
• Morning journals and trigger tracking
• Personalised insights including PCOS-specific scoring

3. Your account

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate health profile information (inaccurate information will produce inaccurate scores)
• Notifying us immediately of any unauthorised use of your account

4. Subscriptions and payments

Gutski offers paid subscriptions managed through the Apple App Store. By subscribing, you agree to:

• Pay the listed subscription fees, billed through your Apple ID
• Automatic renewal at the end of each billing period unless cancelled at least 24 hours before renewal
• Apple's standard terms for in-app purchases

5. Acceptable use

You agree NOT to:

• Use the Service for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated systems (bots, scrapers) to access the Service
• Resell, redistribute, or commercially exploit the Service
• Upload malicious code or attempt to disrupt the Service
• Impersonate another person or misrepresent your affiliation
• Submit photographs of other people without their consent
• Use the Service in any way that violates Apple's App Store Terms

6. Intellectual property

The Service, including the Gutski name, logo, mascot, "Gut Score" methodology, AI models, and all content (excluding user-submitted content), is owned by NO CAP KRE8 LLC and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

7. Your content

You retain ownership of content you submit (meal photos, journal entries, profile data). By submitting content, you grant us a worldwide, royalty-free licence to use that content solely to:

• Provide the Service to you
• Improve our AI models on aggregated, de-identified data
• Comply with legal obligations

This licence ends when you delete your content or account, except for de-identified aggregated data used for model improvement.

8. AI-generated content disclaimer

Gutski uses AI to analyse meals and generate coaching notes. AI outputs:

• May contain errors, inaccuracies, or omissions
• Are not medical advice
• Should not be relied upon for clinical decisions
• May reflect biases in training data

You use AI-generated content at your own risk.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that the Gut Score or any AI-generated insight is accurate.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NO CAP KRE8 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THAT PERIOD, OR $100 IF YOU PAID NOTHING.

11. Indemnification

You agree to indemnify and hold harmless NO CAP KRE8 LLC, its officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time through the App settings.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations, indemnification) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of [REPLACE: state/country] without regard to conflict of law principles.

14. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance. If you don't agree with changes, stop using the Service.

15. Apple-specific terms

The following applies if you downloaded the App from the Apple App Store:

• These Terms are between you and Gutski, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide support for the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
• You confirm you are not located in a country subject to US embargo and are not on any US government list of prohibited parties.
